of Use of MyLocker Self-Service Luggage Lockers
§ 1 General Provisions
1. These Terms and Conditions define the rules for providing and using the Self-Service Luggage Lockers (hereinafter referred to as the "Locker" or "Lockers"), offered by EURO INWEST - BIS Sp. z o.o., with its registered office in Katowice (40-847), at ul. Józefa Pukowca 17, entered into the Register of Entrepreneurs under KRS number 0000295608, NIP: 6321944914, REGON: 240793115 (hereinafter referred to as the "Operator").
2. The Lockers are intended for short-term, self-service storage of luggage and other permitted items by individuals (hereinafter referred to as the "User").
§ 2 Acceptance of the Terms
1. Every User intending to use the Locker is required to read these Terms and Conditions before starting to use the service. The Terms are available directly on the Locker panel and on the Operator's website at https://mylocker.online/terms.
2. Starting to use the Locker (in particular, making a payment and placing an item inside) is equivalent to full acceptance of the provisions of these Terms and Conditions.
§ 3 Items Permitted for Storage
Items allowed for storage in the Lockers include hand luggage or other personal belongings, excluding the items listed in § 4.
§ 4 Prohibited Items
It is strictly forbidden to store the following items in the Lockers:
- Humans and live animals
- Animal remains, unless preserved in a way that completely prevents decomposition.
- Perishable items, items emitting strong or unpleasant odors, items that may spoil or attract pests (e.g., non-hermetically sealed food, open food containers, organic waste, strongly scented substances).
- Items of significant value (monetary or sentimental), including but not limited to: cash, securities, promissory notes, checks, payment cards, ID documents, passports, important personal or business documents, keys, jewelry (including precious metals and stones), watches, works of art, antiques, collectibles. The Operator is not liable for the loss or damage of any valuable items left in the Locker.
- Natural furs and high-value leather goods.
- Electronic and optical equipment such as laptops, tablets, smartphones, cameras, camcorders, drones, e-book readers, GPS devices, data carriers (hard drives, USB drives). The Operator is not liable for their loss or damage.
- Items whose possession, transport, or trade is prohibited by Polish or international law (e.g., drugs, psychotropic substances, firearms and ammunition without required permits, child pornography, stolen goods).
- Hazardous materials: flammable (e.g., gasoline, solvents, oil-based paints, fireworks, gas containers – including aerosol sprays and hair sprays), explosive, corrosive (e.g., acids, alkalis), toxic, radioactive, oxidizing, infectious, or otherwise posing a risk to people, property, or the environment. This also applies to batteries (especially lithium-ion) outside of devices in which they are normally used.
- Alcohol (especially in open containers or in quantities suggesting commercial intent), tobacco products in large amounts.
- Medicines, especially those requiring special storage conditions or available only by prescription.
- Wet items that may cause moisture or damage to the Locker or other stored items.
- Sharp tools or objects (e.g., knives, machetes) that are not properly secured (e.g., in a sheath or protective case).
§ 5 Storage Period and Conditions
- Basic Storage Period: The standard, prepaid storage period is 24 hours, unless the price list or information on the Locker panel at a specific location clearly states a different basic period (e.g., 12 hours).
- Maximum Storage Period: The total single-use storage time in the Locker must not exceed 72 hours (3 days), unless the specifics of a given location (e.g., opening hours of the facility) require a shorter period. The maximum allowed storage period for each location is stated on the Locker panel.
- Start of Period: The storage period begins once payment for the basic period is made, the item is placed in the Locker, and the Locker is properly closed.
- End of Period: The storage period ends when the Locker is opened by the User using a valid access code.
- No Access During Storage: Once the Locker is closed, it cannot be reopened during the paid storage period without ending the current rental cycle. Opening the Locker always ends the storage period.
- Waiver of Right of Withdrawal: According to Article 38(12) of the Polish Consumer Rights Act of 30 May 2014, by making the payment and starting to use the Locker, the User agrees to the immediate start of the storage service and waives the 14-day right of withdrawal from a distance or off-premises contract.
§ 6 Fees
- Use of the Lockers is subject to a fee. The current price list for the basic storage period and any additional periods is displayed on the Locker control panel.
- Fees are charged according to the following rules:
- For the first (basic) storage period: The fee must be paid in full in advance, before placing the item and closing the Locker, regardless of whether the Locker is used for a shorter time during that period.
- For each additional started storage period (after exceeding the basic period): The fee is charged according to the price list for each additional started basic period (e.g., each started day after the first day). The amount due for extra periods must be paid when retrieving the item. The Locker can only be opened after full payment of the amount shown on the display.
- Available payment methods are indicated on the Locker panel.
§ 7 Access Code
- After payment and closing the Locker, the system generates a unique access code (usually printed). The User is responsible for keeping the access code safe and not sharing it with third parties.
- Loss of Access Code: In case of loss or damage to the access code, the User must contact the Operator’s service (contact details in § 13). Opening the Locker in such cases requires technician intervention and is subject to a handling fee of 100.00 PLN (in words: one hundred Polish zloty) to cover the cost of service and emergency opening.
§ 8 Exceeding the Maximum Storage Period
- If the stored item is not collected before the expiration of the maximum storage period (as defined in § 5 point 2), the User must immediately contact the Operator’s service team by phone (contact details in § 13).
- If the User does not contact the service within 24 hours after the maximum storage period has expired, the Operator has the right to open the Locker in the presence of a commission and remove its contents.
- The removed items will be transferred to the Locker Service Office of the Operator (address: ul. Józefa Pukowca 17, 40-847 Katowice) according to the internal schedule, no later than 30 days after the locker has been opened by the commission.
- The Operator undertakes to store the items transferred to the Locker Service Office for a period of 3 (three) months from the date of the commissioned opening of the Locker, subject to § 8 point 5.
- Items that cannot or should not be stored for 3 months due to their nature (e.g., food, perishable goods) may be disposed of by the Operator immediately after the Locker is opened or at any time before the end of the 3-month period, without the User’s right to compensation.
§ 9 Retrieval of Items from the Locker Service Office
- 1. Retrieval of stored items from the Locker Service Office (in the situation described in § 8) is possible by prior appointment and upon meeting all of the following conditions:
- Providing information that allows for unambiguous identification of the items and verification of the identity of the person collecting them as the User or someone authorized by the User.
- Payment of the storage fee for the period from the end of the paid time until the date of the commissioned opening of the Locker, calculated as a multiple of the basic storage fee (according to the price list valid on the original rental date) for each started 24-hour period.
- Payment of an additional fee of 100.00 PLN (in words: one hundred Polish zloty) for the costs of the commissioned opening, clearing of the Locker, and transport and handling of the items at the Locker Service Office.
- In case of lost access code – payment of the handling fee referred to in § 7 point 2 (100.00 PLN).
- If personal collection is not possible, the User may request shipping of the items to a specified address at their own expense (courier service), after settling all due fees. The Operator is not responsible for any damage during transport.
§ 10 Handling of Unclaimed Items
- Items not collected from the Locker Service Office within 3 months from the date of the commissioned opening of the Locker (in accordance with § 8 point 4) shall be deemed abandoned property under Article 180 of the Polish Civil Code. The Operator shall acquire ownership by taking autonomous possession and may handle them at its own discretion, without any right of the User to compensation.
- The Operator may, at its own discretion, subject the abandoned items to:
- Sale
- Free donation for charitable purposes or to an appropriate institution
- Destruction (disposal)
- In case of sale of abandoned items, the funds obtained will first be used to cover all costs incurred by the Operator (including fees listed in § 9 point 1 letters b, c, d).
- Identity documents or other documents enabling the identification of the owner, found among the unclaimed items, will be returned to the last known address at the User’s expense or handed over to the relevant authorities, if possible and appropriate.
§ 11 Liability
- The Operator is not liable for the loss or damage of items stored in the Lockers if the User has violated the provisions of these Terms and Conditions, especially the prohibitions listed in § 4.
- The Operator is not liable for damages caused by force majeure, acts of vandalism, burglary, or other circumstances beyond its control.
- The User is fully liable for any damages caused to the Operator or third parties by the User or by items placed in the Locker (e.g., leakage, fire caused by a defective item). The Operator will seek compensation from the User in accordance with the general principles of the Civil Code.
- The Lockers are under video surveillance to ensure safety and to investigate any incidents.
§ 12 Complaints
- All complaints regarding the operation of the Lockers or charged fees should be submitted immediately, preferably after prior phone contact with the service team.
- Complaints are accepted only in written form (email) sent to: reklamacje@mylocker.online.
- The complaint submission should include at least:
- The complainant's full name.
- Contact details (phone, email).
- Locker number and location.
- Date and approximate time of the incident.
- Detailed description of the issue.
- Payment transaction number or other proof of payment (if applicable).
- Preferred resolution method (e.g., refund).
- The Operator will review the complaint within 14 business days from the date of receipt. In cases requiring further investigation (e.g., surveillance footage analysis, payment verification), this period may be extended, and the User will be informed accordingly.
- If the complaint concerning payment is accepted, the refund will be processed within 7 to 31 business days (depending on the payment method and settlement cycle) to the bank account provided by the User or another agreed method.
§ 13 Service and Contact
- In case of emergencies, Locker operation issues, or lost access codes, please contact the technical service at the phone number indicated on the locker unit.
- Service response time (including on-site visit if necessary) is up to 24 hours from the moment of reporting.
- Fee for unjustified service call: If the service is called for a situation not caused by a Locker malfunction but due to user error or unfamiliarity with the Terms, the Operator reserves the right to charge the User a fee of 100.00 PLN (in words: one hundred Polish zloty).

§ 14 Personal Data Protection
- The controller of Users' personal data processed in connection with service requests, complaints, or the need for identification when collecting items from the Locker Service Office is EURO INWEST - BIS Sp. z o.o.
- Providing personal data (e.g., name, phone number, email address, bank account number for refunds) is voluntary but necessary to process a service or complaint request or to release items from the Locker Service Office (§ 9 point 1 letter a). Refusal to provide data will prevent the execution of these actions.
- Personal data is processed solely for the above-mentioned purposes and for the purpose of pursuing or defending against potential claims. The legal basis for processing is the necessity to perform the contract (Article 6(1)(b) of the GDPR) and the legitimate interest of the controller (Article 6(1)(f) of the GDPR).
- Video Surveillance: The User acknowledges that the area where the Lockers are located is under video surveillance conducted by the Operator or the facility manager. The processing of image data is based on the controller’s legitimate interest (Article 6(1)(f) of the GDPR) to ensure the safety of people and property, protect against claims, and verify service execution or complaint resolution. Recordings are stored for no longer than 90 days, unless they serve as evidence in legal proceedings—in which case, until the final conclusion of the proceedings.
- Personal data will not be shared with third parties, except for authorized service personnel, complaint handlers, data processors acting on behalf of the controller (e.g., IT service providers, security companies operating the surveillance), courier companies for shipments (§ 9 point 1 letter e), and authorities entitled under the law.
- Data will be processed for as long as necessary to fulfill the intended purpose, and afterward for the statute of limitations period for potential claims. Surveillance data is stored in accordance with the retention period mentioned in point 4.
- The User has the right to access their data, rectify it, delete it (in cases provided by law), restrict processing, object to processing based on legitimate interest (including image processing from surveillance), and the right to data portability (in a limited scope), as well as the right to file a complaint with the President of the Personal Data Protection Office.
- Starting to use the Locker service is equivalent to acknowledging the information on personal data processing provided in this section.
§ 15 Final Provisions
- These Terms and Conditions are made available to Users by being posted in a visible place on the Locker panel and [optionally: on the Operator's website]. They are available in both Polish and English. In case of interpretative discrepancies, the Polish version shall prevail.
- For matters not regulated by these Terms, relevant provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
- The Operator reserves the right to amend these Terms and Conditions. Amendments shall take effect on the date indicated by the Operator, not earlier than 7 days from the date of announcement in the manner specified in point 1. Amendments do not apply to contracts concluded before the new Terms and Conditions come into force.
- These Terms and Conditions come into force on July 1, 2025.
